On our website, the following General Terms and Conditions (GTC) apply in the version valid at the time of the order. Oral side agreements have not been made. You can save the GTC on your computer and/or print them out for the purpose of the online order.
In accordance with the German Youth Protection Act, we do not sell alcohol to young people under 18 years of age. By placing an order, the buyer confirms that he/she is of the required age according to the German Youth Protection Act. We reserve the right to request proof of age.
Quality Guarantee:
All our wines are carefully cultivated, produced by ourselves and bottled in our winery. Wines that do not suit you can be returned at your expense and risk at the purchase price. Under certain circumstances it can come to precipitations of tartar. These crystals (salts of tartaric acid) are an expression of gentle winemaking and do not impair the quality of the wine. Therefore they are not a reason for complaint.
Replacement:
If not expressly requested otherwise, we will deliver the next vintage for a possibly no longer available variety, as is customary in the industry, provided it is equivalent in variety, quality grade and price.
Incorrect delivery, shortages, breakage:

Payment:
We accept payment in advance, by Paypal or by credit card.
You will receive an invoice from us, which is also an order confirmation. The invoice is usually enclosed with the delivery. The invoice is payable upon order and before delivery. All prices include the legal value added tax. The prices valid at the time of the order are charged. The delivered goods remain our property until full payment has been received.
If the goods have not been paid for 30 days after receipt of goods and invoice, default of payment shall automatically occur without the need for a reminder. In this case Andre Macionga Cuvee GmbH can demand statutory default interest, which is 5% above the current base rate. If the Andre Macionga Cuvee GmbH can prove that it has incurred additional damages due to the delay, these can also be claimed.
The customer may only offset such counterclaims that have been legally established.
Applicable law/court of jurisdiction:
All differences of opinion and legal disputes arising in connection with the business relationship shall be governed exclusively by German law, excluding the UN Convention on Contracts for the International Sale of Goods.
Offer validity:
The prices at the time of the order shall apply. Errors excepted. If a vintage is drunk up, the price is no longer valid.
Severability clause:
If individual provisions of these General Terms and Conditions and/or of the contract supplemented by them are or become invalid, the validity of the other provisions shall not be affected thereby and the contract and these General Terms and Conditions shall otherwise remain valid for both parties.
